Ethics of use of gathered email addresses?

Take this situation: a quite popular blog which requires valid email address for commenting. Owner wants to use these email addresses for sending periodical email newsletters to the commenters (I would be the coder who creates the back end to do this). I’m a bit concerned, because the commenters left those addresses with one particular purpose and they were never told that it will be used for newsletters. Is this ethical?

Additionally, they would be able to opt out from this system but only after receiving the first newsletter.

Do the people who start phishing emails ever get caught?

I’m so angry, I have received several phishing emails lately. Does anyone know if these people ever get caught, and what penalties they have to face?

Here is some more information on the emails I received, and a warning to everyone who reads this!

Warning: There are at least 2 phishing emails going around that look very, very real! I received them both lately, and they made me very angry! Scam One: This one claims to be from the irs and it says they have your refund ready. To refund it to your bank account, it directs you to a site to put in all of your personal information. Do not enter your personal information, this is a scam! IRS never sends emails like this, if you choose to do taxes online, YOU go to THEIR site. Scam Two: First you receive a fake email from Paypal telling you that someone is trying to get into your paypal account to make payments. Then you receive a second fake email telling you that a payment had been made via paypal, and to cancel the payment put in your personal information. It is very real looking, and very believable! Please, do not put in your personal information! Paypal does not contact people via email, they will contact you through your paypal account.
